Elon Musk’s X Risks Nationwide Ban in Brazil

Elon Musk’s social media platform, X, formerly known as Twitter, is under significant threat of a nationwide ban in Brazil after failing to adhere to a court order issued by a prominent Brazilian judge. The ruling, handed down by Judge Alexandre de Moraes, calls for the suspension of the platform, a move that could potentially cut off access to tens of millions of users across the country. This development has significant implications for both X and its global operations.

The suspension order issued by Judge Moraes did not result in an immediate shutdown of X in Brazil, according to reports from The Washington Post. This legal action follows a series of confrontations between Musk and the judge, who has been at the center of multiple legal disputes involving X. In recent weeks, Musk has publicly criticized Moraes, exacerbating the tension between the two.

X’s global government affairs page anticipated this legal action. On Thursday, the page suggested that Moraes would issue the suspension order due to the platform’s refusal to comply with what it claimed were attempts to censor the judge’s political opponents. In response, X stated it would not “comply in secret with illegal orders,” emphasizing its commitment to transparency by publicly disclosing Moraes’ demands and related court documents. Earlier this month, X had already voiced its objections to another order from Moraes that required the platform to block certain accounts linked to a government investigation into “digital militias” accused of disseminating disinformation.

Should the ban be enforced, it would significantly impact Brazil’s digital landscape. Approximately 40 million Brazilians use X at least once a month, as reported by the Associated Press, citing data from market research group Emarketer. The potential loss of Brazilian users would represent around 7% of X’s claimed global user base of 570 million. Although it is uncertain how a ban would affect daily user figures, which X claims to number 250 million globally, the impact would undoubtedly be substantial.

X has yet to comment on the potential ramifications of the ban or its plans to address the situation. However, the ongoing legal conflict has already involved Musk’s satellite company, Starlink. Moraes’s court froze Starlink accounts, leading Musk to assert that the order obstructed Starlink’s ability to conduct financial transactions in Brazil. Starlink has disputed this, describing the court’s action as “unfounded” and blaming it for imposing financial penalties on X that Starlink should not be responsible for.

Musk’s public criticism of Judge Moraes began in earnest in April. At that time, X’s global government affairs page reported that it was forced to suspend certain Brazilian accounts without clear reasons for the violations. This action was part of a broader investigation into “digital militias” alleged to be spreading misinformation and divisive content. Musk characterized the court’s orders as “draconian” and criticized Moraes for what he perceived as unjust demands. This criticism escalated when Musk suggested that X would not fully comply with Moraes’s directives, leading the judge to accuse him of obstruction. The situation worsened as Moraes included Musk in an investigation into X’s compliance with the court’s orders. Reports from Brazil’s federal police indicated that while X partially complied with the order, some accounts remained active.

The latest escalation in the dispute came when Moraes set a deadline for X to appoint a local legal representative by 8 p.m. local time on Thursday or face a potential ban. Musk responded to this ultimatum with a tweet accusing Moraes of “repeatedly breaking the laws he has sworn to uphold.” The ongoing exchanges between Musk and Moraes suggest that X is unlikely to yield to the legal demands. X’s recent statements and public posts indicate a firm stance against Moraes’s orders, although it remains unclear when a ban might be enforced or whether X will appeal the decision. The platform has reportedly tried to defend itself in court, but its appeals to the Brazilian Supreme Court have not yet been addressed.
