Georgia Appeals Court Delays Trump’s Election Case

The Georgia Court of Appeals has temporarily halted the election interference case involving former President Donald Trump and his co-defendants. The pause comes as the court considers whether Fulton County District Attorney Fani Willis should be allowed to prosecute the case, effectively postponing any potential trial until after the November election.

Wednesday’s decision suspends further proceedings until a ruling is made on Trump’s appeal, which argues that Willis should be disqualified due to a perceived conflict of interest. Trump’s legal team alleges that Willis violated public money laws by maintaining a relationship with a prosecutor on her team. Judge Scott McAfee previously ruled that while Willis did not need to be disqualified, either she or the prosecutor in question should step down from the case. The prosecutor, Nathan Wade, promptly withdrew from the case. Trump subsequently appealed this decision.

The appeals court has scheduled a hearing on Trump’s appeal for October 4th. A final ruling on whether Willis can continue with the case is not expected until mid-March 2025. This timeline makes it unlikely that the case will proceed to trial before the presidential election on November 8th.

McAfee had previously allowed proceedings to continue while Trump appealed his decision, according to CNN.

Significantly, Trump is facing ten felony charges in Georgia, including a violation of the Georgia Racketeer Influenced and Corrupt Organizations Act. Originally, the indictment included 13 charges, but McAfee dismissed some in March. Prosecutors are appealing to have these charges reinstated.

Last August, Trump and 18 co-defendants were indicted in Georgia for their alleged roles in attempting to overturn the 2020 election results in the state. Trump pleaded not guilty, while several co-defendants, including Jenna Ellis, Kenneth Chesebro, Sidney Powell, and Scott Hall, accepted plea agreements and pleaded guilty. This trial is one of four legal battles Trump faces while running for reelection, including the recent New York hush money trial in which he was convicted. He also faces charges in Florida for mishandling classified documents and federal charges for attempting to overturn the 2020 election results. However, it is increasingly unlikely that either of these cases will go to trial before the general election in November.

In another legal development, a federal judge in Florida, Aileen Cannon, appointed by Trump, has scheduled hearings later this month in Trump’s case involving the mishandling of classified documents. Prosecutors are pushing back against the slow progress of the case and the granting of hearings for Trump’s legal arguments, which could further delay the trial.
