On Tuesday, America PAC took to the platform X to share the news, stating that it has mailed out “more than 87,000 checks to people who referred signers of our petition,” with an additional 100,000 checks set to go out the following day. The announcement raises questions about whether this total encompasses all referrals collected to date or if the PAC intends to distribute more checks in the future.

The PAC has committed to paying individuals $47 for every successful referral of a registered swing state voter who signs the petition, which emphasizes support for the First and Second Amendments. Musk’s overarching objective is to amass one million signatures from voters in pivotal swing states, a target that could significantly amplify the scope of the PAC’s outreach efforts.

Considering the current distribution of checks, the financial implications are notable. The 187,000 checks could represent nearly $8.79 million in payouts, assuming each recipient referred only one registered swing state voter. However, the actual figure is likely to be higher, given that individuals can refer multiple voters to sign the petition.

In a related development, the America PAC has been conducting a daily sweepstakes, offering $1 million payouts to petition signers, with a total of 11 such awards granted thus far. The latest recipient hails from Griffin, Georgia. Eligibility for the sweepstakes requires petition signers to be registered voters in one of seven critical swing states, with past winners including four from Pennsylvania, two from Michigan, and one each from North Carolina, Wisconsin, Nevada, Arizona, and Georgia.

America PAC’s funding primarily stems from Musk himself, who has emerged as one of former President Donald Trump’s most influential supporters. According to filings with the Federal Election Commission (FEC), Musk has donated over $118 million to the PAC as of October 16. This positions him as Trump’s second-largest financial backer, following billionaire Timothy Mellon, who has contributed $150 million to pro-Trump initiatives.

Despite the PAC’s ambitious financial offerings, it has faced serious legal scrutiny. Reports from CNN indicated that the Department of Justice’s public integrity division, which focuses on investigating potential election-related crimes, has warned America PAC in recent days that its $1 million giveaways could be in violation of federal election laws. Legal experts have raised concerns about the implications of paying individuals for voter registration or voting, with federal law stating that such actions could result in penalties of up to $10,000 and a five-year prison sentence.

The legal challenges intensified further when Philadelphia District Attorney Larry Krasner filed a lawsuit against Musk and America PAC, seeking an immediate halt to the million-dollar payouts. Krasner has characterized the payouts as part of an “illegal lottery scheme” aimed at influencing voter behavior, thus raising significant ethical and legal questions surrounding the PAC’s activities.

As of mid-October, America PAC reported having raised approximately $130 million, although it has also spent around $127 million, leaving a slim margin for future expenditures.
